1. Agreement
These Terms of Use ("Terms") govern your use of the Cacatua mobile application and web application (the "Services") provided by Guillermo Nimubona Castrillo ("we", "us"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 16 years old to use the Services. By using the Services, you represent that you meet this age requirement.
3. Account
To use certain features, you must create an account via Google or Apple Sign-In. You are responsible for maintaining the security of your account credentials and for all activity under your account.
4. Description of the Services
Cacatua is a speech-to-text application that provides:
- Streaming mode: Real-time speech recognition with live transcript display
- Recording mode: Record audio for batch transcription
- Web viewer: View and manage transcripts in a web browser
- LLM post-processing: AI-powered refinement of transcripts into structured notes (Pro only)
5. Subscriptions and Payment
5.1 Free Tier
The free tier includes 30 minutes of ASR per month and access to live streaming mode.
5.2 Pro Subscription
Cacatua Pro is available as a monthly subscription at the price displayed in-app. Pro includes 10 hours of ASR per month and access to all features including LLM post-processing.
5.3 Billing
Subscriptions are billed through the Apple App Store or Google Play. Payment is charged at confirmation of purchase. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription through your device's app store settings.
5.4 Refunds
Refund requests are handled by Apple or Google per their respective policies. We do not process refunds directly.
6. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose
- Attempt to circumvent usage quotas or security measures
- Reverse engineer, decompile, or disassemble the Services
- Use automated systems (bots, scrapers) to access the Services
- Transmit content that is harmful, threatening, abusive, or otherwise objectionable
- Use the Services to process audio of third parties without their knowledge and consent where required by law
7. Intellectual Property
7.1 Your Content
You retain full ownership of all transcripts, refined notes, and any content generated from your audio. We claim no intellectual property rights over your content.
7.2 Our Services
The Cacatua application, including its design, code, branding, and documentation, is the property of Guillermo Nimubona Castrillo. You may not copy, modify, or redistribute the application or its components.
8. Privacy
Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
9. Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that:
- Transcriptions will be accurate or error-free
- The Services will be uninterrupted or available at all times
- LLM-generated notes will be factually correct or suitable for any particular purpose
You acknowledge that speech recognition and AI-generated content may contain errors and should be reviewed before relying on them for critical purposes.
10. Limitation of Liability
To the maximum extent permitted by applicable law, our total aggregate liability for any claims arising from or related to the Services shall not exceed the amount you have paid us in subscription fees during the 12 months preceding the claim. In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages.
11. Account Termination
You may delete your account at any time from the app's Settings screen. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Services ceases immediately.
12. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via the app or email with at least 15 days' notice. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of Spain. Any disputes arising from these Terms shall be submitted to the courts of Valladolid, Spain. If you are a consumer within the European Union, you retain the right to bring proceedings in the courts of your country of residence, and nothing in these Terms affects your statutory consumer rights under EU law.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
